    Dear SGT McClain,

    My name is Janis I have two sons one is autistic twenty years old and other one in the USAF airman 3 stripes who works on airplanes.

    He was just transferred to Ramstein not there for three weeks yet, went out on Sat night with a friend took the train and a cab to his car reason being he needed hotel key, as his apt was not ready yet, police stopped him and got a DUI I am heartsick.

    He turned the car in today, finally got his place to live with furniture delivered, saw a lawyer who said not doing much for him. Went to an AA class to be evaluated, asked for a counselor to get him through this ordeal. Not being prejudice I doubt if he is an alcholic, but should not have gotten into the car rather took the cab to the hotel.

    With your background in the service what do you think is going to happen to him>

    Mrs Korkos,

    I’m sorry it doesn’t look good for your son, the services very slightlight as far as what they may do in a situation like this but depending on who stopped him (German Police or MP’s) will depend greatly on what the military does next.

    If it was the MP’s then they will probably revoke is Drivers Licences for a period of time and give him some form of Non-judicial punishment. Don’t worry that would probably be the best thing for him because that wouldn’t follow him on the civilian side of the house.

    Now if he was stop by the German Police it may be a totally different story, then he would be subject to German law in accordance with the Status of Forces Agreement (SOFA) I haven’t worked on any cases from Germany so I am not sure how this would affect him there or what would possibly carry back over to the US. In the US he would be subject to any punishments and penalties that any other person would be if they got a DUI.

    I wish I had more answers for you. I will ask some of my fellow paralegals and attorneys and see if they have any other information that they can put out.
